The Ministry of the Economy, Tourism and Sport has published a proposal for a new Hospitality Industry Act, which, among other things, regulates the short-term rental of apartments (for example, via the Booking and AirBnb online platforms) and defines new types of accommodation facilities. The proposal will be publicly discussed until June 17, 2024, while the law is expected to be adopted by the National Assembly by the end of this year.
If the proposal will be confirmed, the following will apply:
– An individual apartment can be rented as a whole or in part for a short-term lease of up to 30 days in a calendar year. It can be rented out for a longer period of time if the municipality determines so with a general act,
– the share of consent of the co-owners in a multi-apartment building must be 75 percent, but it is also mandatory to obtain the consent of the municipality,
– without the time limits of the municipality, the apartment can be rented out, if it will be converted into a business premises through a change of purpose – that is, into a catering establishment (now also self-catering accomodation),
– new independent types of accommodation facilities have been introduced, namely self-catering accomodation, tent sites, motorhome parking, glamping and superior accommodation facilities in nature.
